Terms & Conditions

The terms that govern how Nawah engages with clients and how our platforms may be used.

1. Overview & Acceptance

Accessing or utilizing Nawah’s website, digital platforms, or consulting and development services constitutes full acceptance of these Terms & Conditions. Discontinuation of platform use is required if these terms are not accepted.

2. Nature of Engagement

Nawah operates as a digital consultancy and product development partner. Individual project scopes, timelines, technical deliverables, and commercial terms are established through independent Statements of Work (SOW) or Service Level Agreements (SLA) executed separately for each client engagement.

3. Intellectual Property Rights

Proprietary Assets: All source code, frameworks, design system components, UI elements, brand assets, and internal methodologies displayed across Nawah platforms remain the exclusive intellectual property of Nawah.

Client Deliverables: Intellectual property rights for bespoke digital products and software developed specifically for a client transfer to that client only upon full settlement of all contractual financial obligations.

4. User Conduct & Security

Interacting with Nawah platforms requires adherence to strict digital safety protocols:

  • Prohibition of transmitting malicious code, malware, viruses, or security exploits.

  • Prohibition of unauthorized access attempts to internal servers, databases, or restricted platform endpoints.

  • Prohibition of automated scraping, data harvesting, or reverse engineering without prior written authorization.

5. Limitation of Liability

Platform interfaces, content, and services are provided on an “as-is” and “as-available” basis. Nawah assumes no liability for indirect damages, business interruption, loss of profits, or data loss resulting from third-party tool failures, external network outages, or unauthorized platform misuse.

6. Governing Law & Jurisdiction

These terms are governed by and construed in accordance with the laws, regulatory frameworks, and digital compliance standards (including ZATCA and PDPL guidelines) applicable in the Kingdom of Saudi Arabia.
